TOMORROW LAND APPARELS PVT. LTD. (hereinafter referred to as "the Company") is the owner and the service provider of internet-based apparel retailers called Bombay Shirt Company, and Pause that provide custom-made as well as ready-to-wear shirts, jeans, chinos, pants, blazers, t-shirts & womenswear. The registered office is at 101A Marathon Chambers, N.M. Joshi Marg, Lower Parel East, Mumbai 400013.

AVAILABILITY AND DELIVERY
Some of our products are made-to-order, while all others are made in small batches. Delivery time will vary from product to product and cannot be guaranteed. An indicative time period is approximately 7 to 14 days, excluding shipping time. Garments designed with premium fabrics may take up to 21 days for delivery. Shipping delays due to courier companies cannot be controlled by Tomorrowland Apparels Pvt. Ltd. If your chosen fabric is sold out or has a delay in delivery from the manufacturer post-purchase, we will offer you similar options. If the options are not suitable, a refund will be provided for the garment in question (unless clubbed with a promotional offer). Items purchased via a gift voucher are not entitled to a refund in cash or credit.

YOUR ACCOUNT
You agree that any use of the site is at your own risk and the Company is not responsible for it. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. Your unique identifier is your email ID. You are responsible for updating the same as we will send all communication on your order status and delivery details to this email ID only. Further, adding your mobile number to the account information allows us to contact you in case of any requirements to schedule appointments, alterations, advise delivery of orders as well as any unforeseen circumstance. We respect your privacy. In compliance with data privacy laws governing the jurisdictions in which we provide our service, you may delete your account at any time. Upon any termination, discontinuation, or cancellation of Services or your Account, the following provisions will survive: "Pricing", "Payment", "Trademark Copyright and Restriction", "Privacy Policy", "Governing Law & Arbitration". You may at any time unsubscribe from our newsletters, email, or SMS campaigns by clicking on the appropriate settings in your Profile on our website.

PRODUCT DESCRIPTION
The Company tries to be as accurate as possible in the representation of information on the website and in our stores. However, the Company does not warrant that the product description or other content of this site is accurate, complete, reliable, current, or error-free.
Our customization software is a computer render of the actual fabric. Colours and patterns may appear different based on the screen resolutions being used. The final garment may differ slightly from that of the image being displayed.

MEASUREMENTS
Every fabric has a unique weight, feel, and fall, hence measurements may appear to be different. There may be slight variances in fit based on fabrics. For all made-to-measure garments, all measurements provided are final garment measurements and will be produced within a general 0.5" tolerance of those measurements. All ready-to-wear garments are made in standard sizes; you can choose whichever size you like.
We have a single repository for measurements for a customer's garment. The most recent version of the measurements will be referred to as the base measurement for the customer profile.

  • Your base measurements stay linked to your profile.
  • Any updates done from the profile page will update the base measurement and will apply to open orders (not in production).
  • Changes made while creating/editing an order will update the base measurement and link the base with open orders.
  • Changes made while creating/editing alterations will update the base measurement, open orders (not in production), and other open alterations.
  • Once your order/alteration goes into production, the measurements are frozen for the particular order. Any measurement changes from the profile or other orders won't be applied to this order.
  • If your account is used by a family member/ relative or acquaintance and their measurements are stored on the system, then the Company will alter the same if possible, at no cost to the customer. No refunds or cancellations of these orders will be accepted.

PRICING
Whilst we try to ensure that all details, descriptions, and prices that appear on this website are accurate, errors may occur. If we discover an error in the price of any Product or Service that you have ordered from the Company, we will notify you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. We allow changes or cancellations within 24 hours of order placement. If you cancel and you have already paid for the Product or Service, you will receive a full refund. Refunds will be made via the same payment mode and will be credited within 7 working days after the refund is initiated. Our prices when shopping online from India are inclusive of GST. At our stores, Tax is applicable at checkout. For shipments outside of India, you will be solely responsible for calculating and paying any and all taxes, customs duties, fees, etc. imposed by the destination country in relation to the Product(s) or Services. Delivery costs may be charged in addition; such additional charges are displayed where applicable and included in the total cost.
For our international customers, please note that all charges are in the currency displayed on the website. In case of any interbank fees, the Company has no control in determining what these charges are and it is understood that the customer will bear these charges (if any). In case of any COD amount, the Company has the right to use the loyalty credits accumulated by the customer to offset these charges.
In case where a refund is issued, we will not refund any shipping charges, customs duties, or taxes as applicable. Items purchased on Sale at our Stores are not eligible for returns, refunds, or alterations.

PAYMENT
Our domestic prices are inclusive of GST. Tax is applicable at checkout. Payments may be made by Mastercard, Visa, PayPal, or wallets as offered by our payment gateway processor - Cashfree. The safety of your credit/debit card information is of paramount importance to us. We do not store any credit/debit card information and your payment details are automatically encrypted when you enter them. Upon receiving your order we carry out a standard pre-authorization check on your payment card to ensure there are sufficient funds to fulfill the transaction. Products will not be dispatched, and Services will not be performed until this pre-authorization check has been completed. Your card will be debited once the order has been accepted.
Gift Vouchers cannot be purchased using Loyalty Credits.

This site is controlled and operated by Tomorrowland Apparels Pvt. Ltd. All material on this site, including images, illustrations, audio clips, and video clips, are protected by copyrights, trademarks, and other intellectual property rights that are owned and controlled by us or by other parties that have licensed their material to us. Material on the www.bombayshirts.com website owned, operated, licensed, or controlled by us is solely for your personal, non-commercial use. You must not copy, reproduce, republish, upload, post, transmit, or distribute such material in any way, including by email or other electronic means. You must not assist any other person to do so, either directly or indirectly Without the prior written consent of the owner, modification of the materials, use of the materials on any other website or networked computer environment or use of the materials for any purpose other than personal, non-commercial use is a violation of the copyrights, trademarks, and other proprietary rights, and is prohibited. Tomorrowland Apparels Private Limited (“Tomorrowland”) acknowledges that the name of our city was changed from Bombay to Mumbai by the Corporation Resolution No. 512 dated August 12, 1996, Maharashtra Act, XXV of 1996.
The name “Bombay Shirt Company” pays tribute to the heritage of tailoring in our city, in an era when Mumbai used to be known as Bombay. Tomorrowland does not in any manner intend to disrespect or hurt anybody’s sentiments by referring to Mumbai as Bombay.

PRIVACY POLICY
The Company values its customers and respects their privacy. We collect customer information in an effort to improve your shopping experience and to communicate with you about our products, services, and promotions. The Company recognizes that it must maintain and use customer information responsibly. We will not rent, give or sell your personally identifiable information to any outside organisation for that organisation's own use without your consent. We give out necessary information such as your name, address and contact details to the delivery company solely for the purpose of completing your order transaction. Your data will not be provided to third parties for marketing. We do not store any credit card information.

CHANGES TO TERMS OR SERVICES
We reserve the right to update or modify these Terms and Conditions at any time in our sole discretion. If we do so, we'll let you know either by posting the modified Terms on our website(s) or through other communication. It is important that you check these terms regularly because if you continue to use the Services after we have posted modified Terms on the Sites, you are indicating to us that you agree to be bound by the modified Terms. You may choose to discontinue our service if you don't agree to be bound by the modified Terms. Because the Services are evolving over time, we may change or discontinue all or any part of the Services, at any time and without notice, at our sole discretion.

ALERTS AND NOTIFICATIONS
As part of our Services, you may receive notifications, alerts, emails, requests for feedback on our products and services, delivery status messages or other types of messages regarding our Services. We may also periodically send you emails that directly promote the offerings of the  Company. When you receive such promotional emails from us you will have the opportunity to "opt-out" by following the UNSUBSCRIBE instructions provided in the email you receive.

LIMITED LIABILITY
For all purchases made online and in stores, the Company's liability extends to the value of the products purchased by the customer.

ALTERATIONS, EXCHANGES + REFUNDS

  • We offer free alterations/exchanges/refunds as applicable for 30 days from the time of delivery, in-store or at home. You can bring your garment to any of our stores (Insert store page) or have it picked up at home for free within those 30 days.
  • After 30 days, we charge a flat fee depending on the type of alteration you require. You can bring your garment to any of our stores or contact our customer service team for assistance. For more information on alteration rates, please read our Terms & Conditions.
  • Ready-to-wear garments cannot be altered.

    • Only available at stores
  • Refunds are processed within 7 days of receiving your garment.
  • We do not offer alterations/exchanges/refunds for customers based outside India.

Post the 30 day period, alterations will be charged as per the rate chart below

  • For any part changes - Collar/Cuff/Placket/Front/Back/Sleeve - INR 700/- (inclusive of GST)
  • For any Measurement changes - INR 500/- (inclusive of GST)
  • For  changes like button changes/monogram - INR 300/- (inclusive of GST)

LOYALTY POINTS
Effective 26 August 2020, we discontinued the issuance of Loyalty Points. Loyalty Points will now be treated as Store Credit. Points previously earned through shopping online or through our Stores, are all credited to your online profile. These points may be redeemed through any of the above channels in the future until the date of expiry (i.e. 1 year from the date of issuance).
To view your account balance, simply login to your online profile.
Sign-up bonuses are only available for customer profiles made online and not in stores. The validity of this is 1 month and we do not provide an extension of the timeline. Loyalty Points / Store Credit is non-transferable from one account to another. They cannot be redeemed as cash and expire after 365 days of issue. The company reserves the right to change the terms of the loyalty program.

PROMO CODE
The Company may at times offer promotional codes to our customers to avail of special discounts and offers. The promotional codes cannot be used in conjunction with any other offers. Promotional codes are also not valid on purchases using Loyalty Credits. Orders using promo codes are not entitled to Loyalty points. These codes for garments may be restricted to a particular category. The Company retains the right to honour promotional codes or disallow the same if it has been deemed to be used for the purpose of gaming the system. Both the ‘5PLUS1’ offer - Buy 5 and get the 6th garment free, the discount is applicable on the item of lowest value in the transaction.

  • You can purchase membership at a store near you or online, at a price of INR 990.

How do I know I’m a member?

  • Simply log into your account. You can view your membership status on your account page.

How do I get access to my private concierge service?

  • Simply call +91 8928774101 for concierge access. If you hear a busy tone, we’re probably speaking to another priority customer. We’ll call you back as quickly as possible.

How do I get faster delivery of my shirts?

  • Our made-to-order shirts usually ship in 10-12 days. Member orders get put in front of the queue, based on current order volume. 

Where are gift vouchers and how are they used?

  • Your voucher will be active after 15 days of purchase of membership to The OutFit.
  • The voucher is one-time-use only, and will be valid for the entirety of your membership tenure, i.e. 12 months. 
  • The voucher can be redeemed either at a store or online, using your unique code.

How long will my membership be active?

  • Your membership will be active for 12 months from the date of purchase. 

How do I avail of alterations?

  • You can ship the order back to the store nearest to you, or take it into the store yourself. You can also arrange to have it picked up by us. 

Does my membership renew automatically?

  • No. We will be in touch with a reminder to renew, but it will have to be renewed by you manually. 

Can a family member or friend use my membership discount? 

  • No. Your membership is unique to your profile, hence cannot be transferred.

Can I club my membership discount with another one?

  • Your 10% discount can not be clubbed with any other offers. 

Can I avail the membership discount of 10% to buy a gift card?

  • No, there will be no discounts offered on our gift cards. 

Can I use my discount in the store and online?

  • Yes. Your 10% discount will be applicable on all your orders, online or in-store.

Can I cancel my membership after purchase? 

  • No. Your membership may be canceled by us in case of misuse or for any other reason, at our sole discretion.

REFERRAL PROGRAM
The Company may at times offer a referral program (branded as "Refer & Earn") to our customers for them to receive benefits by recommending their friends and/or family members to make purchases on the Company's website. The referral program is administered by ReferralCandy and by signing up for the program, ReferralCandy will be provided with the customer's name and registered email address. The promotional codes obtained as part of this program cannot be used in conjunction with any other offers. The terms and conditions of the program are as follows (a) You will be entitled to 20% off your next purchase after your friend/family member has completed their purchase on the Company's website and the same has been verified by the Company. (b) Both your purchase and the friend/s you refer must make purchases on the Company's website only to avail of this offer. Purchases made at physical store locations will not be considered as part of this program. (c) This program is not valid in North America i.e. Canada, USA, and Mexico. (d) The referral program is not valid at any of our stores in India or globally. (e) The coupon code issued to you for 20% off is valid on purchases that must be done within 30 days. (f) If a customer already has an existing account with any of the brands of the Company, then neither party shall be entitled to the benefits of this program. (g) The coupon code validity cannot be transferred to another customer/user and cannot be renewed once expired. (h) The Company at its sole discretion may choose to void the referral offer if, in its opinion, the referrer has not referred family/ friends but has chosen to register additional email addresses for the purposes of availing the promotional discount offered. These codes for garments may be restricted to a particular category. The Company retains the rights to change, modify the terms, or cancel the program at any time without any other notification to the customers apart from updates on this Terms & Conditions page.

GOVERNING LAW AND JURISDICTION
This Agreement shall be interpreted and construed in accordance with the laws applicable in India. The courts of Mumbai, India shall have exclusive jurisdiction in any matter relating to or arising out of this Agreement.

GIFT VOUCHERS
Gift vouchers can be purchased at our stores, our website or through partner portals as electronic gift vouchers. The following conditions will apply in regard to their validity and redemption:

  • Items purchased via a gift voucher are not entitled to a refund in cash or credit.
  • Gift Vouchers cannot be purchased using Loyalty Credits.
  • All gift vouchers have a validity of 1 year from the date of purchase. They cannot be refunded in cash or credit to the beneficiary or the purchaser.
  • Gift vouchers are for a single user only and cannot be redeemed for the purchase of items for another customer, i.e. they are non-transferrable.
